Examples of jurisdictional mis-selling and irregular contracts by RDO resorts

Real Sentences & Purchase Agreements

Here are a small amount of sentences against Club La Costa & Diamond Resorts where M1 Legal have secured victories.  At the time of publishing this article, they have secured so far in 2019, 36 Judgements against a variety of timeshare resorts ordering monies to be paid to clients and the total sum awarded is in excess of £500,000. Furthermore, they have secured 18 victories on jurisdiction whereby the defence argued that the case should be heard in the UK. However the appeal judge ruled that these cases fall under Spanish jurisdiction. All of these cases have been re-submitted through the lower courts. Below are a small amount of sample of sentences. Although they are in Spanish you can clearly see the name of the resort and if applicable the amount awarded.  Personal information has been omitted for obvious reasons.

It seems rather strange that Kwikchex have never reported these sentences. Kwikchex has assisted clients in taking legal action against ITRA which has only resulted in additional costs for the clients with no financial reimbursement.
